This Agreement is between Nethra91 and the individual or entity ("Customer") using our software services, including SMS, WhatsApp, and School ERP solutions. By using our services, you agree to the terms outlined below. Please read carefully before using our services.
Services
Nethra91 provides software services, including but not limited to SMS, WhatsApp messaging, and School ERP solutions, for educational institutions and other organizations. We aim to deliver high-quality, reliable, and secure services to all users.
Usage Terms
Customers are responsible for ensuring their use of our services is lawful and in accordance with this Agreement. Our services are provided based on the following usage guidelines:
✽ SMS and WhatsApp Messaging: Messages sent through our platform must comply with all applicable laws and regulations. Customers are responsible for ensuring that the content of their messages is appropriate, legal, and does not violate privacy or intellectual property rights.
✽ School ERP Services: Nethra91 offers an ERP platform designed for managing school operations, including student data, attendance, fee management, and communication. Customers must ensure that the data entered into the platform is accurate and secure.
Payments
Customers agree to pay for the services provided by Nethra91 according to the pricing plans chosen. Payment is required in advance for each service period. Failure to make payments may result in suspension or termination of services.
✽ Renewals: Renewal notices will be sent before the due date. If payment is not received within the specified time, your service may be suspended until payment is made.
✽ Refunds: Nethra91 offers a 30-day money-back guarantee for our software services. However, this refund policy does not apply to SMS credits or WhatsApp services. Once purchased, credits for SMS and WhatsApp are non-refundable.
Data Protection and Privacy
Nethra91 takes the security of customer data seriously. We comply with all applicable data protection laws and implement appropriate measures to safeguard your personal and organizational data.
✽ Customer Responsibility: Customers are responsible for maintaining the security of their login credentials and ensuring that their use of the platform does not compromise sensitive information.
✽ Data Sharing: Nethra91 does not share customer data with third parties without consent, except where required by law.
Cancellation and Termination
Customers may cancel their service by providing written notice. Nethra91 reserves the right to terminate service without notice in cases of violation of these terms, unlawful activity, or failure to make timely payments.
Prohibited Activities
The following activities are strictly prohibited:
✽ Sending unsolicited bulk messages (SPAM) via SMS or WhatsApp.
✽ Using the platform to distribute illegal, harmful, or abusive content.
✽ Attempting to interfere with or disrupt the service or network.
Violation of these terms may result in immediate suspension or termination of your account without refund.
Limitation of Liability
Nethra91 shall not be held liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services. Our total liability for any claim related to the service shall not exceed the amount paid by the customer for the service during the preceding three months.
Service Availability
We strive to provide uninterrupted service; however, Nethra91 does not guarantee 100% uptime. Scheduled maintenance and unforeseen technical issues may result in temporary service outages.
Amendments
Nethra91 reserves the right to update or modify these Terms of Service at any time. Customers will be notified of significant changes via email or through a notice on our website.
Governing Law
This Agreement is governed by the laws of India, and any disputes arising from the use of our services will be subject to the exclusive jurisdiction of the courts in Chennai.
